Agreement to Terms

By accessing or using LinguaFlow (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not use our App.

Description of Service

LinguaFlow is a Shopify application that provides AI-powered translation services for Shopify store content. The service includes:

• Translation of store content using enterprise-grade AI translation
• Content synchronization with Shopify stores
• Translation management and publishing
• Character usage tracking and monitoring
• Support and documentation

Account Terms

Shopify Account Required

• You must have a valid Shopify store to use LinguaFlow
• You must provide accurate and complete information during setup
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account

Age Requirement

You must be at least 18 years old to use LinguaFlow. By using the App, you represent that you meet this requirement.

Account Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your credentials secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Acceptable Use

You May

• Use LinguaFlow for your legitimate Shopify store translation needs
• Translate content you own or have rights to translate
• Export your translated content
• Provide feedback and suggestions

You May Not

• Violate any laws or regulations
• Infringe on intellectual property rights
• Use the App for fraudulent purposes
• Attempt to circumvent usage limits or restrictions
• Reverse engineer, decompile, or disassemble the App
• Interfere with the App’s operation
• Access the App through unauthorized means
• Use the App to harm others or the service
• Resell or redistribute the service without authorization

Translation Service Terms

Your Responsibility

You are responsible for:

• Complying with these terms of service
• Monitoring your character usage and subscription limits
• Ensuring you have rights to translate your content
• Reviewing translations for accuracy before publishing
• Managing your subscription and billing

Fees and Payment

Subscription Fees

• Subscription fees are billed through Shopify
• Fees are charged in advance on a monthly or annual basis
• Translation service is included in your subscription
• Character usage limits apply per plan tier
• Overage charges may apply if exceeding plan limits
• All fees are non-refundable except as required by law or stated in our refund policy
• Prices may change with 30 days notice

Refund Policy

• 30-day money-back guarantee for first-time subscribers
• No refunds for partial months
• Refunds processed within 10 business days

Failed Payments

If payment fails:

• We’ll attempt to re-bill
• Service may be suspended after repeated failures
• Account may be terminated if payment issues aren’t resolved

Service Availability

Uptime

We strive to provide 99.9% uptime but don’t guarantee uninterrupted access. Service may be unavailable due to:

• Scheduled maintenance (with notice)
• Emergency maintenance
• Factors beyond our control
• Translation provider availability

No Warranty

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be uninterrupted or error-free
• Translations will be accurate or suitable for your purposes
• The service will meet your requirements
• Errors will be corrected

Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Liability For

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Translation quality or accuracy
• Third-party actions (including translation providers)

Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Exceptions

Some jurisdictions don’t allow limitation of liability, so these limitations may not apply to you.

Intellectual Property

Our Rights

• LinguaFlow retains all rights to the App, including code, design, and branding
• “LinguaFlow” and our logo are our trademarks
• You may not use our trademarks without permission

Your Rights

• You retain all rights to your original content
• You retain rights to your translated content
• We claim no ownership of your store data

License to Use

You grant us a limited license to:

• Access and process your content for translation
• Store your data as necessary to provide the service
• Display your content within the App interface

This license ends when you delete content or uninstall the App.

Data and Privacy

Data Processing

By using LinguaFlow, you consent to:

• Collection and processing of your data as described in our Privacy Policy
• Transfer of your content to translation providers
• Storage of translations and metadata

Your Data Rights

• You own your data
• You can export your data at any time
• You can request deletion of your data
• Data is deleted within 30 days of app uninstallation

Data Security

We implement reasonable security measures but cannot guarantee absolute security. You acknowledge the inherent risks of internet-based services.

Termination

By You

You may terminate at any time by:

• Uninstalling the App from your Shopify store
• Canceling your subscription
• Contacting support

By Us

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• Your account is inactive for extended periods
• Required by law
• We discontinue the service (with 30 days notice)

Effect of Termination

Upon termination:

• Your access to the App ends immediately
• Your data will be deleted within 30 days
• No refunds for remaining subscription period (except as required)
• Sections that should survive termination will remain in effect

Indemnification

You agree to indemnify and hold harmless LinguaFlow from claims arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of third-party rights
• Your content or translations

Changes to Terms

We may modify these Terms at any time:

• Changes effective upon posting
• Continued use constitutes acceptance
• Material changes will be notified via email
• You may terminate if you disagree with changes

Dispute Resolution

Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.

Arbitration

Failure to enforce any provision doesn’t waive our right to enforce it later.

Assignment

You may not assign these Terms. We may assign them with notice to you.

Force Majeure

We’re not liable for delays or failures due to circumstances beyond our reasonable control.

Legal notices will be sent to the email address associated with your account.

LinguaFlow integrates with Shopify and is subject to:
